After a Utah Car Accident, Do You Sue the Driver or the Insurance Company?

Video Description

After a collision, no your first step in most instances is not to just go sue the defendant driver. Again, you’re going to go through a medical evaluation. We need to evaluate the incident itself. We’re going to evaluate your medical condition. We’re going to look at your medical treatment plans and your medical records. We’re going to get all that done. Once you’re finished treating, or you’re close to finishing treating, or we kind of know the extent of your  injuries, then we’ll get into the negotiation process with the adjusters and try to get you  a resolution. And that can take some time to go through that but it’s all of that’s done well in advance of anybody contemplating filing suit. Now, the only time that’s not true is if you wait too long. So, if you wait and you don’t come to us, you try to kind of handle things on your own for a year or so, and then it comes to us, and we’re getting close to what’s called a statute of limitations, we may have to file a lawsuit. Again, that’s something that we will advise you  about. We’ll answer any questions that you have. We’ll kind of walk you down that road and let you know everything you need to know so that you can make a well-informed decision about whether or not  you want to pursue a lawsuit, but lawsuits are not the first step. They’re very far down the road.
