Why You Need a Syracuse Car Accident Lawyer

After a car crash, it’s difficult to take on the challenges of pursuing fair damages while also healing. Proper legal analysis and skilled negotiating come with experience.

An experienced car accident attorney recognizes insurance company tactics to deny or minimize payments. An adjuster may try to trick you into saying something that shows you were at fault or puts the seriousness of your injuries in doubt. They may also offer a quick settlement so you accept before realizing the scope of your injuries or car repair costs.

Our local car accident lawyers know state laws that apply to car accidents and are familiar with Syracuse, Layton, and other Utah communities. We often know the judges and attorneys, and sometimes even the insurers involved in your case. We also understand that it can be hard to decide to file a claim.

As we explain during our free consultations, most car accident claims are against insurance companies that collect premiums in exchange for benefits. Our Syracuse car accident attorneys fight for victims when an insurer doesn’t live up to its end of the bargain.

Understanding Syracuse Car Accident Laws

Utah is a no-fault insurance state. That means you turn to your coverage first for medical bills and lost wages, regardless of who caused the crash. If another party was at fault, you can file a third-party claim with their insurer for property damage, remaining medical bills, and wage loss.

If you are partially responsible for your accident, you can still collect damages. Under the Utah comparative negligence law, you can seek compensation if you were 50 percent or less at fault. However, your percentage of blame reduces your compensation proportionally. If you had a crash with $100,000 in damages and were 10 percent responsible, you could collect $90,000.

Under Utah’s personal injury statute of limitations, you typically have four years from your crash date to file a lawsuit in civil court. There are only limited exceptions to this timeline, and if you fail to file before the deadline, a judge will dismiss your claim. If your loved one died in a car crash that was someone else’s fault, you generally have two years from the date of death to sue.

Minimum Insurance Requirements in Utah

You must carry personal injury protection (PIP) in Utah. PIP is your no-fault coverage and covers costs related to your injuries. The state has a $3,000 PIP minimum, but this likely will not cover your medical bills and wage loss after a serious accident.

In Utah, you must also have liability coverage to protect others if you are at fault in a crash. The minimum liability coverage in Utah as of January 1, 2025, is $30,000 for injury or death of one person, $65,000 for injury or death to two or more people, and $25,000 for property damage.

It is wise to carry more than the minimum insurance if you can afford to do so. Medical bills add up quickly, and electronics in modern vehicles can be expensive to replace. Increasing your liability coverage may protect you against a lawsuit if you cause a crash.

Compensation You May Be Entitled To

You can pursue financial and emotional damages in a Syracuse, UT, car accident claim, collectively called compensatory damages. A judge may also allow you to seek punitive damages to punish the offender for particularly egregious acts.

Economic Damages

Economic damages cover your financial losses, which you can prove with medical bills, repair estimates, wage statements, and other records or receipts. Examples of economic damages include:

  • Medical bills and future medical costs
  • Rehabilitation and physical therapy
  • Lost wages and future earnings
  • Nursing or other home care
  • Property damage

Non-Economic Damages

Car accident victims often face physical pain and the psychological impact of the crash and its aftermath. You can seek non-economic damages, including:

  • Pain and suffering
  • Emotional distress
  • Loss of consortium
  • Loss of enjoyment of life
  • Scarring and disfigurement

Punitive Damages

In Utah, punitive damages are generally allowed only when you can show, with clear and convincing evidence, that the defendant intentionally caused harm or acted with extreme negligence. In DUI-related crashes, however, you need only prove your right to punitive damages by a preponderance of the evidence.

What To Do After a Car Accident in Syracuse

There are several steps to take after a car accident that protect your health and your future claim. Once you take actions like seeking medical care and preserving evidence, there is more you can do to strengthen your case for an insurance claim or lawsuit.

Contact an experienced car accident lawyer in Syracuse, UT, who can review your claim and collect evidence you were unable to obtain. Avoid speaking to insurance adjusters until an attorney has reviewed your case, and never give a recorded statement without your lawyer present.

Act quickly so your attorney can preserve evidence before it disappears or witness memories fade. Getting your lawyer involved early to build a strong case based on Utah law and solid evidence puts you in a better position in settlement negotiations with insurers.
